The EU’s High Court cleared the way for such claims last year, when it ruled that enforcement agencies should pay interest on fines already paid in those dropped antitrust cases. The judge also held thatInterest on overdue payments also accrues interest in itself.

Intel filed an application with the General Court of Luxembourg, which said the European Commission refused to pay interest on arrears. In January of this year, the European Commission returned $1.2 billion to Intel.

Intel explained that its claim is based on the 1.25% refinancing rate that the ECB has implemented since May 2009. The EU repaid the fine to Intel in February this year, minus the 38 million euros in interest paid to Intel by the European Commission, but from August 2009 to February this year, the EU refinancing rate has climbed to 3.5%.
